The U.S. Senate made strides Tuesday to approve an extension of unemployment benefits that will give out-of-work Americans till November to enroll in the federal Emergency Unemployment Compensation program, and fully fund Extended Benefits programs (.pdf) in states — like Florida — suffering from high unemployment. But a line in Florida law currently prohibits the Sunshine State from receiving and disbursing the additional E.B. funding promised in the legislation.

At least one Florida lawmaker — state Rep. Kevin Rader, D-Boynton Beach — called on Gov. Charlie Crist, state House Speaker Larry Cretul and state Senate President Jeff Atwater to fix the issue during this week’s special session, but that idea went nowhere. The state legislature called an end to the session after less than three hours. That means that thousands of Floridians who have exhausted their normal state and EUC benefits will be denied the federal government’s additional lifeline payments.
Senate Bill 1736, which passed during the Florida legislature’s 2010 regular session, stipulates that those who have exhausted normal state and EUC benefits must have established “entitlement to extended benefits” before June 2.
On its website, the Agency for Workforce Innovation — which administers Floridians’ unemployment benefits — states that the “legislation does not provide for EB entitlement remaining on claims after June 5, 2010.”
During negotiations this past spring, Rep. Rader tried to amend S.B. 1736 to allow the state to pay out additional benefits to the unemployed if “an Act of Congress continues to provide 100 percent federally funded extended unemployment compensation benefits between May 1, 2010, and the first day of the 2011 Regular Session.”
The amendment failed, ostensibly because its implementation would have depended on a federal vote. But Rader thinks there’s a simpler explanation. ”It was the majority party not wanting to do the right thing at the time and look ahead and really, in my eyes, do the prudent, fiscally responsible thing,” he says.
On Monday Rader sent a letter to Crist (CCing Cretul and Atwater) that asked the governor to expand his call for a special session to include a fix to the Florida statute that deals with extended benefits, and on Tuesday Rader filed legislation that would do just that. Rader’s law would have kept extended benefits flowing as long as “100 percent federal sharing is available.” In his letter, Rader warned that if Florida’s statute is not amended, the state “stands to miss out on approximately $290 million of federal funds.”

The Florida legislature, though, refused to consider Rader’s proposed legislation (or anything else for that matter), concluding its business in just two and a half hours, without even voting on the stated purpose for the special session: to debate placing a constitutional offshore drilling ban on Florida ballots this November.
The Agency for Workforce Innovation confirms that the legislative fix would not have cost the state a dime. “EB costs are funded by the federal government providing eligibility for EB is not extended by state law beyond the period covered by full federal funding,” writes AWI spokesperson Robby Cunningham via email. Cunningham also confirms that no Florida business would see its unemployment insurance rate go up should the fix have been implemented.
“This is really a very dark day, I think, in the legislature,” Rader says, pointing out how effective unemployment benefits are as a stimulus: “When you take these dollars and you bring it right into the hands of unemployed individuals, it goes right into the economy.”
Rader cites AWI numbers that estimate that every dollar spent on unemployment benefits generates $1.64 in economic activity. “These dollars are a lifeblood,” he says, “not just for the unemployed and their families, but for businesses all over Florida.”
After the legislature adjourned early Tuesday, Rader vowed to urge Gov. Crist to issue an executive order to correct the problem: “We can’t have 35,000 Floridians losing their benefits.”

Govenor Crist should be ashamed for not correcting this problem, I can't believe Florida people will loose out on $290 million dollars to help us who are looking for a job and our unemployment benefits have ran out or will soon run out. I put this to him. Lay him off and I'd like to see him try and make it on $255.00 wkly. Govenor Crist you need to get your act together and do the right thing for the Floridian unemployed people. We shouldn't have to beg nor plea, but I will PRAY YOU MAKE THIS CHANGE.

I can't understand how the politicians of Florida can turn their backs on the down trodden (unemployed) of Florida. The weekly unemployment checks are not very large, but it supplies the gas money to pay for the car to take you to interviews, job fairs, job links ect. Are they so out of touch with the Floridian Citizens that they don't know how it is to look for a job and not find one, even minimum wage jobs? How many homeless people do they think this state can hold, because many of us who have been bounced off the unemployeement are only weeks away from not having a place to live…how heartless can they be? Of course they have their nice cozy homes to go home to and can pay their bills.
I guess it was easy for them to cut the special session short since they where there to help the poor (unemployed) and their interest does not seem to be with them at all.
Gov Crist we are asking you to do your job and step in and make sure we get out unemployment extendtion!

I am one of the umemployed listed here. I am out of benefits. I have lost my home and am living in a family members home in a travel trailer and my next step is to leave Florida to try to find work elsewhere. I see a great migration of people leaving Florida every day. This is sad. I am trying to find work but have two ruptured discs in my neck that I can't get fixed. I could take a job using my 15 years of office experience but can't do anything physical at this time. Shame on you, FLorida, for not taking care of your own.

It really makes me sick to read this. Its obvious that these politicians don't care for anyone but themselves. I'm sure they would take the $290 million if it was going to their pockets. God forbid they would think about all the single mothers that have lost their benefits and will soon be homeless. Just turn your backs on the Floridians that kept Florida going when the economy was good. Kick them while their down.
Gov. Christ do the right thing .Help the unemployed Floridians that kept this state going but now need a little help to keep going themselves.

It was NOT the Governor's fault that this ammendment was not even heard! It was the Republican legislators who just wanted to get into the special session and get out as soon as possible without hearing any information or any debate on anything!
In Florida, as well as in the rest of the country, the American people are worthless in the eyes of the G.O.P. They have proven this over and over again by continually voting down the extended unemployment benefits for the past few months.

My benefits ran out July 3, 32 days after the Florida Legislatures stupid lawsaying that one had to sign up for extended benefits by June 2. So, I am out of benefits.
Now the fools in the FL legislature refuse to even consider accepting 290 million in free Federal Money to help out Floridians. Maybe Christ should sign an “Executive Order” to get the unemployment benefits money for us (Obama signs Executive Orders all the time and they work.
This November let's get rid of everyone who cares more about themselves than “We the People”.

out of unemployments because this state is too stupid to give what every other state out their gets 99 weeks. i have been out of work here since dec 08 and have had 2 interviews. i used to make 100k plus and now am waiting on to become homeless. we all need a teir 5 and maybe a 6 and 7 based on congress. we should stop paying all govt workers and employees and see what they think about 275 a week to live on… spit on these scumbags and vote them out this fall. if they would just create some jobs we might all be alright. godbless and my prayers are out their for all in my situation. i thought this was america the greatest country on earth. we'll i guess they will have to drop poptarts from b2 bombers to people down here , since we can't even get food stamps , this state sucks and they call it paradise

The article mentioned Larry Cretul and Jeff Atwater, both Republicans. Crist should have pushed for it, but these guys were at least as guilty. Rader, a Democrat, pushed for unemployment extension in Florida. Democrats care about the unemployed, Republicans don't!

All these politicians need to become unemployed and see where they end up. I would love to see them make it on the unemployment benefits, although small, they manage to keep families afloat. Its rough out there, jobs are scarce and this would help many families and the Florida economy. It makes me very sad hopefully they can fix this and restore faith!

I am a single mom of 3, I lost my job in Jan 2010, have only recieved 1 tier of unemployment and now nothing more, my x-husband has been on unemployment for over two years and I have been recieving a small fraction(regulated by the state) of my child support, I now will get nothing from him due to lack of extension. BTW, the state of Fl handles my child support and it is out of my hands what repercusions my x recieves or doesn't recieve for not paying. I have lived in Fl my whole life, I am a third generation floridian from miami, I now live in a small town on the SW coast and can not even find a fast food job, I have a college education and many years of work experience but there are just NO jobs, not even part time. I am in the process of losing my house, and my dignity…how could the powers that be in Fl be so heartless to deny there citizens FREE money? I was OK with the fact that no state was getting it but I just feel violated in the fact that it is FL (people with jobs) that are denying us. I feel like I am in the twilight zone or some cruel disgusting nightmare….some one please wake me up.

I can't believe that Christ has not fixed this problem yet! Why did they wait until so many people lost there benefits here in FL before they even started to discuss it!! If the gov. would have taken care of this ungodly law before they went on break for the 4th then we would get benefits like the rest of the USA!!!!!!! We have one of the worst economy's in the United States and still declineing thanks to the oil spill and now I guess we are suppose to either move or lose everything that we have worked our entire lives for! We have to stand up and say something if not when does it stop?

I'm not sure why articles such as this continue to appear. FL has the normal benefits and the Extended Benefits. EB comes after you have exhausted your regular benefits and the Federal EUC benefits. In effect, it provided a Tier V of sorts after the Tier I-IV EUC were exhausted (technically, I guess that would make it Tier VI, eh?).
Articles such as this make it difficult to keep up to date and clear on what is actually being done. EUC is not EB. EB comes after EUC.

LOL I was getting 84 dollars a week bud, 275 would have allowed me to actually eat every day, now I eat once every two and on extreme occasions 3 days depending. I am living in my car, which will be 2 months late on August 1st and its my bday on the 29th… I dont think this is worth it, but I was thinking that the same date for your death being your bday would save money on the tombstone that I wont be able to afford to pay for… Cant even afford to die, God help us.

Thanks to the economy, my employer closed shop on 11/29/09. I received ONE tier of benefits. Since my last week of benefits for that Tier was in June, I did not qualify for ANY extended benefits. I applied for EB EUC ABC and XYZ and am told that is just the way it worked out. Some people are on Tier V and still getting benefits, mine ended after one Tier. I don't understand why those grandfathered in are getting continuing, but those that first went on in late 09 are out of benefits. It's LIFO- last in, first out. So at this point, if the Federal extension goes through, I'll get additional benefits. But only if Crist and the numnut politicians can manage to sign a piece of paper releasing the funds.

EUC and EB are not the same. When EUC will pick up is at question after it passes the House and the President signs it into law (ie, how long will it take for it to go into effect). EB will require the FL legislation to pass an amendment/law/etc.

No.. you're wrong. As soon as it's signed into Federal law, you'll be getting the benefits. It's the way the dates worked out. You're not a 99er. You're eligible and will be receiving a check that is retroactive as soon as Obama signs it into law.. EUC and EB are 2 different things… I'm not sticking up for any politicians. But I think this news article should have been written clearer as to not cause panic.

Absolutely Marilyng!!! That's exactly what I experienced…only ran out of my Tier I 3 weeks into July…had about $600 left in July, so I missed the filing deadline of May 29th because you had to be “out of funds in your claim” by then…reason I was NOT out of funds??? BECAUSE I TOOK A FEW PART-TIME SUBSTITUTE TEACHING JOBS which as we all know deduct from what you are paid, thereby making your money last longer, which is what we're SUPPOSED TO BE DOING, right??? Working when we can find it, right??? But NO!!! I was told by Fl. Unempl. worker that if I had “run out of my money by the 29th” I would have “advanced to Tier II,” which means if I had SAT ON MY LAZY BUTT like all the ignorant and angry people chastizing us seem to call us, lazy! Well, I'm a prime example of how NOT LAZY I was, and that's WHY I lost my chance at the next Tier, right in time for summer vacation when obviously there was NO more chance for substitute work, duh!!! THE SYSTEM IS BACKWARDS!!! Should have consulted with someone on welfare prior to being unemployed to see how the TRULY LAZY work the system, instead of being an honest, hard-working, but unfortunately to not fault of my own, laid-off full-time worker since age 15, and single mother!!! Btw, I have a college degree, and NO ONE will hire me at a minimum wage job, NO ONE! They WANT dummies or kids apparently! This whole situation is ridiculous. I had held a job since my sophmore year in high school and now the Florida government isn't acting or at least informing anyone about extensions. I don't expect to live off the system for forever but there are no jobs to be had, from Jacksonville where I just lost my house to Cape Coral where I relocated to. Good thing my mom lives here, looks like my family and I may have to try squeeze in her place. I just got a letter from social security saying if I die my family would get $2700 a month benefits until my children were grown. Maybe my answer is in death? Does this apply if I commit suicide? I am feeling inspired. Thanks Florida Government for you assistance in my clarity.

I did the same thing,. Worked part-time to do the right thing (even though it cost me more money to work than stay home because of gas, etc.) But I made it by a wire. If I had earned one more hour I would have not gotten the EB. But I am still confused about whether I will get this or not or whether it will depend on Crist or the Legislature. Everyone is confused. I called about my individual account this morning and they couldn't tell me anything until the President signs it off — and then will probably take a few more days. This is a disgrace for Florida. It's the same as what happened in South Carolina, and a class action suit has been filed against the State because it refused the Federal money months back. Good luck to everyone. I am praying for us all. And regardless how it turns out for me, I am in this fight till the end. I have a job interview at Publix next week, don't know how it will go, but I am fighting mad over this and will continue my letter writing for the unemployed and against the GOP. Please everyone, don't stop fighting this unfairness no matter what your individual situation will be. The GOP is counting on us giving up, not having computers to blog, not having the energy or motivation to vote in November. VOTE!!!!! Remember the Dems were our only hope and keep them in office and get more elected as well.

son's tier 2 benefits expired on june 7. If he was laid off a few days earlier, he would be okay . let's hope everyone bombards Crist and the others with emails up the kazoo. Aren't we U.S. citizens? We paid taxes. This is not charity. We all contributed when we received paychecks. Crist should remember how many votes gave Bush the advantage in Fl. I am 60 years old, unemployed and no matter how well qualified and experienced I am, no one is hiring “the elderly” I guess. What is wrong with the Florida Legislature, not willing to help us out? I received my regular unemployment and one emergency tier. As a diabetic, on a pump with three thousand of dollars of perscriptions expenses each quarter, I wonder how in the world I will make it!! I did not ask to be laid off. I have been out of benefits since June, AFTER the cut off date. This makes me sick too, what is wrong with Christ and the legislature?

My husbands benefits ran out on July 9th, he only got 3 months of unemployment. I haven't been able to find a job since I was laid off in Dec 09..
So, every other suffering state is going to get federal money, just not here in Florida, one of the hardest hit states. REally?

I am with you, this is really bad. I first heard last night that it passed & I was happy and then I heard about Florida and I could not believe it. So when everyone else is finally getting what they “NEED” we are just waiting. Could thing they can pay for their $5000 dinner dates and everything else. It just makes me so mad. We can not wait until Sept to get this money. It is going to cause an uproar (it probably has already), it is a disgrace. I would not vote for any of those crooks. Hopefully something is done with the executive order, it is not that hard!!!!

i waited all night on tuesday to see if it would pass. it did. i was so happy and i thanked god for answered prayer before i went to sleep. maybe i could keep my little dumpy rental and not have to sleep in the car. then the next morning i read this!! I am totally at a loss for words. where is the compassion in our government? What is the Governor thinking allowing this to happen to his people. those who put him where he is. I am dumbfounded. It's a very bad situation when you have worked all your life and when you need the goverments help just this one time they fail you, sure the Governor could care less he is not running for the position so its no skin of his back. No income coming into the house, were we are losing our homes, cars, and not to mention our driving privileges, yes, I could not afford to pay my car insurance let alone my car payments. My license got suspended, so go figure how I am going to be out on job interviews with no insurance, no license, and pretty soon no car.

I have been out of work for over a year and I have had four interviews out of hundreds of applications submittted, the last one two weeks ago told me that she recieved 506 resumes for one position…I am losing my home, my car needs repaired and I have no more unemployment since June 5th…I worked for 26 years and never recieved unemployment, food stamps or state help and this is was I get in return. Florida is one of the worst states hit and WE NEED HELP< CRIST NEEDS TO SIGN THE EB BILL immediately before people are crowding the homeless shelters or dying of heat exhaustion from no electricity. Every agency you call for help has exhausted benefits helping Florida families. I am completely disgusted in the state I have called home for so many years.

What Does The State Want To Do Put Us On Welfare??? Than They Can Pay The Price Rather Than The Federal Govt. This Makes No Sense At All. We The Unemployed Demand This Be Corrected At Once. And Give Us The Benefits That Were Voted In Our Favor. I Am Still Waiting For The Last Extension Which Has Not Been Paid Because Unemployment Is So Backed Up. The System Is Horrific And Soon We Will Be On The Streets Or In The System. Something Needs To Change And Quickly.

Aren't the extended benefits referred to in this article (EB) and emergency unemployment compensation (EUC) two different things? I believe they are after looking at the FLUIDNOW website and I think we all will be getting the money we need… deep breath everyone.

Even if you were able to sign up for extended benefits prior to June 2, as I did, and was approved, we are still cutoff from collecting. I was given $5500 in credits, got $600, and that was it. No more, as I was told this morning at Worforce Innovation of Florida. I need legislative action or it's no-go. Has anyone heard more about Crist doing an Executive Order? Why is he being so quiet about this?

I think since we can not pay our rent we should pack our tents and go camp out in their front yards and have them feed us. hook up to their elect. so we have light at night. My husband has been without work for almost 2 yr's. Looking faithfully everyday for a job. Something has got to give. We can not go without houseing,food& electric. Our Gov. has to step up and do something NOW.
Many have done fallen behind on rent and getting eviction notices,I know this month we can not make our rent with out unemployment.

Dear God ,,,let Christ do the right thing. My daughter is one of the many single mothers,who is suffering,(for lack of another word).Has 2 children.one is disabled. She still managed to work.never ask for welfare.Now she has lost her UB,it is critical now.I cannot believe when money is there for everyone else,they can let others lose the very roof over thier head.

Let us all move to Arizona where there will be plenty of jobs now that they are forcing the illegal immigrants to get out. Why has this not happened here in Florida? It's sad when you drive down the streets of Cape Coral, Ft. Myers or anywhere else in SW Florida and see what you know are illegals (They don't speak English. You are suppose to speak English to be sworn in to be an American Citizen, Right?) working on our roads, roofs, lawns, supermarkets, etc., and American born citizens cannot find any jobs. There might be more opportunities rather than NONE if this law was passed here in Florida. Florida Politicians only want the RICH living here. Florida Politicians forget all the people of Florida voted them in and we WILL EASILY VOTE THEM OUT!!! They are only in Session for 2.5 hrs? GET A REAL JOB. Whose money are they collecting for their pay checks? Florida needs all new politicians to help clean this State up. This is a disgrace. If Crist does this as Govenor, what he will do as a Senator? He will not get my vote.

this is real hard to swallow my screen name doesnt speak well for me but im clean over 20 years until now first i lost my great job got a new one minus 10,000 ayear and my health ins than my home which represented almost a ll my life savings lost all its value then the lesser job ended then my unemployment stopped i can only try to rally anyone with common sence to vote anyone that played a part in this out of office

Although I am Happy about this for everyone, my first 26 weeks of Unemployment expires mid Nov 15th if of course I dont find a job, odes this mean that if I do have to file for an extension I will only be able to collect for 2 weeks even though the Federal Govt would have paid me for 20 weeks if I filed before Nov 30th…….

Tcfmn, I believe you should be able to collect Tier 1 EUC (20) weeks as long as your initilal claim expires and the money is gone that you were awarded for your 26 week state claim. Be sure to file long before December 4 or you will be trapped until the House/ Senate votes to extend EUC again. The EB program that Crist signed today allows anyone who has maxed out there regular and EUC Tiers to receive further benefits. I was an interstate claimiant who ran out of my regular benefits( 20 weeks) and received 2 weeks EB because I was stuck in a bad time frame. Now I will be able to claim for Tier 1 EUC. Because Florida had a date of JUNE 5 in there legislation I could not receive EB benefits pass that date and could not file for EUC Tier 1 because it had expired. So im my case EB kicked in before EUC Tier 1 but only lasted 2 weeks because of the starnge Florida law. So complicated dude!

Tcfmn, yes I believe so… but it's always good to get more confirmation from a more reliable source. The EB program halted on June 5th for Florida and will halt again in December along side the Federal EUC program . I was awarded around $3 G in the EB program from a different state but only collected 300 of it because Florida had a cut off date in their legislation. Since you are planning ahead remember that if you accept part time work it will count against your unemployment claim. So lets say you work for 3 weeks in a temp agency. Those three weeks will push you pass eligibilty Deadline to file for Tier 1 EUC in Dec. Or say you have 1 penny left in your unemployment account and miss the deadline. You will be out of luck if another extension for EUC does not pass. So if you get a job make sure it's a good one. So again I do believe as long as file immediately after your regular benefits expire Nov 10 you will be safely placed into twenty weeks of Tier 1 which will take you April. In Dec if no further Extensions are passed by Federal Gov you and will not be able to move into Tier 2 after April. Not every state can collect the Tiers- only ones that have a high unemployment rate. Hope this helps. Blessings to you!!

Yes two different things…EB is like a second roind of state benefits you can get when you have exhuasted both your initial UE from the state AND all your tiers if federal you are eligible for. If you were receiving inital state, tier I, II or II when the federal cutoff came and you ran out of benefits AFTER the end of May then you will be reinstated and moved to the next tier of available benefits…If you went onto EB, the state set the sunset date as of June 5 as the last payment based on the federal benefits cutoff date. Even IF you got on EB prior to June 5 the last date you could get anything from that program was June 5…Now Crist has extended that to December so IF you were already on it and had a “balance” left in funds you will begin receiving those funds again up until December…To move from state initial benefits to federal tier I or to move to the next available federal tier, Crist needed take no action as the extension passed by congress moves the cutoff date to Nov. 28th I believe. That means the last day to move onto a federal tier from state initial is like a week earlier and the last date to move from the tier you are on to the next available tier will be Nov. 28th. Once you are on a federal tier you continue to receive benefits until that tier you are on runs out of money.

Crist's actions have nothing to do with it in your case…Being on tier II means that as soon as congress extends the benefits your son will move directly onto tier III and get all benefits due back to June 7th. Your son is on EUC and not EB.

Their is no “Tier V”….If you exhausted all four tiers of federal EUC after June 2nd, 2010 you can now apply for state EB which will now pay an claimant through I believe December 5, 2010…If you were on your initial state benefits or tier's I, II or III of federal EUC you will move to the next available tier of benefits.
